Wife Charged After Attempting to Frame Husband for Crime Against Child

Criminal offenses against children, such as possession of child pornography, sexual assault against a child, and child abuse, carry more stigma than almost any other crime. This is why false allegations of child sexual abuse are such an alarming issue. A woman in Arkansas is now facing her own criminal charges after fabricating a story about her husband’s alleged crimes against children.

Woman Says She Found Explicit Images of Children on Her Husband’s Phone

In 2018, a 34-year-old Arkansas woman went to police to make a report of her husband’s alleged sexual assault and domestic violence. She claimed that she had caught her husband sexually assaulting a 13-year-old girl and that her husband attacked her when she interrupted the alleged crime. She showed investigators a bruise from the supposed attack as well as pictures on her husband’s phone depicting child pornography. However, when investigators looked further into the woman’s allegations, they discovered that the truth was wildly different than what the woman had claimed.

Husband Cleared of Charges After it Was Determined That He Was Framed

Criminal investigators soon learned that the woman had been kicked out of her home just a few days prior to making the accusations against her husband. They were also able to determine that the wife herself had downloaded the explicit images to her husband’s phone. Eventually, she admitted to investigators that she had downloaded child pornography to her husband’s phone when she was high on methamphetamines. The young girl who the husband was accused of assaulting also denied that the assault had taken place. The wife was convicted of filing a false police report as well as distributing, possessing, or viewing child pornography. She will serve six years’ probation, pay over $2,000 in fees, and register as a sex offender as punishment for her crimes.

Texas Law Regarding Child Pornography

In Texas, a person can be convicted of possession of child pornography if they knowingly possess or view material that depicts a child under age 18 engaging in sexual conduct. It is a third-degree felony offense to possess child pornography in Texas. This crime is punishable by up to 10 years in prison and a fine of up to $10,000. Possession of child pornography with intent to distribute the explicit material is a second-degree felony, which carries a penalty of up to 20 years’ incarceration as well as a fine of up to $10,000.
