"Intoxication assault" is a DWI that results in serious bodily injury. It is a third-degree felony punishable by two to 10 years in a Texas Department of Criminal Justice correctional facility plus significant fines. "Intoxication Manslaughter" is the term used to describe a DWI that causes death. This second-degree felony carries a penalty of up to ten years in prison and a fine of up to $10,000.
